Terms for providers
These terms govern how hosting providers get their offers listed on ServerRadar24 (serverradar24.com) – through a ServerRadar24 feed, a connection to their API or the provider portal. ServerRadar24 is operated by Scherbarth Solutions, owner Fabien Scherbarth, Berggärtenstraße 44, 56564 Neuwied, Germany ("we").
This English version is for information only; the German version is legally binding.
1. Scope
1.1 These terms apply to businesses (entrepreneurs within the meaning of Section 14 of the German Civil Code) that apply through the "For providers" page, whose offers we list or who use access to the provider portal ("providers"). Consumers cannot take part.
1.2 By submitting the application, and at the latest by signing in to the provider portal for the first time, the provider accepts these terms. The provider's own terms and conditions do not apply, even if we do not expressly object to them.
2. Our service
2.1 Being accepted and listed is free of charge. There is no entitlement to be accepted, to be listed permanently or to be presented in a particular way.
2.2 We fetch the provider's offer data automatically at regular intervals (currently about every 5 minutes) and show it alongside offers of other providers. How we sort, filter, group and highlight offers is at our discretion and follows the same rules for all providers. The order does not depend on whether an affiliate programme exists.
2.3 We may prepare the data for display, in particular convert prices into the market's currency (European Central Bank reference rates), show or add the market's sales tax, harmonise names, assign locations, link CPU models to public benchmark data and translate texts.
2.4 We keep price and availability histories from the fetched data and show them publicly, also in aggregated form (for example "availability in percent").
2.5 If a feed is older than 60 minutes or cannot be reached, we show the provider's offers as "availability unknown" until current data arrives. Offers missing from the feed are removed from the listing. Products the provider maintains by hand in the provider portal are shown as "provider information" with unknown availability; in the default view they appear after offers with known stock.
2.6 We strive for high availability of ServerRadar24 but do not owe it. Maintenance, outages and further development may temporarily limit the display.
3. Acceptance and approval
3.1 We review every application and every feed entered for the first time before offers appear. Approval is at our discretion.
3.2 After approval, we apply changes to the feed – including a new feed URL – without another review. A new URL is checked for validity automatically before it is saved.
3.3 We may hide offers or the provider at any time and without giving reasons, in particular in case of breaches of these terms, incorrect, outdated or misleading data, complaints from visitors or third parties, or when we redesign ServerRadar24. Where appropriate, we inform the provider beforehand or promptly.
4. Provider's obligations
4.1 The provider supplies complete, correct and current information. In particular,
- prices, setup fees, term prices and surcharges match the conditions under which visitors can actually order, and are correctly marked as net or gross;
- availability per location reflects the actual state;
- the specifications (CPU, memory, drives, bandwidth, location) match the product that can be ordered;
- every product URL leads directly to the provider's order or product page for exactly that offer.
4.2 The feed is generated automatically from the provider's shop, billing or inventory system and carries a correct timestamp (generated_at). A feed maintained by hand and not updated continuously is not sufficient. If the provider maintains its products by hand in the provider portal instead, it confirms prices and details at least every 14 days; products not confirmed are hidden until they are confirmed again. A provider uses either a feed or API connection or maintenance by hand, not both.
4.3 The feed is reachable via HTTPS and designed so that our regular fetches do not impair it. It contains no personal data, no malware and no content that violates applicable law or third-party rights.
4.4 The provider keeps credentials for the provider portal and the feed confidential, shares access only with its own staff or agents and informs us immediately of any misuse. It is responsible for actions taken through its accounts to the extent it is responsible for their misuse.
4.5 The provider is solely responsible for its offers, its order pages and compliance with the rules that apply to it (such as price indication, competition and consumer law). Contracts for the listed servers are concluded exclusively between visitor and provider; ServerRadar24 is neither a party to them nor an agent.
5. Rights of use
5.1 The provider grants us, free of charge, the simple, non-transferable right to store, prepare, display and compare the supplied offer data as well as its company name and product names on ServerRadar24 and related channels (such as interfaces for search engines and AI, e.g. the sitemap or llms.txt), to the extent necessary to operate ServerRadar24.
5.2 We may continue to use price and availability histories as historical data after participation ends, in particular for statistics and aggregated analyses.
5.3 The provider warrants that it holds the necessary rights to the supplied data and names.
6. Links and affiliate programmes
6.1 Links to offers pass through a redirect on ServerRadar24 (/go/…) that counts clicks. If the provider runs an affiliate programme, we may add our affiliate ID to the links and mark them as advertising. Remuneration is governed solely by the terms of the respective programme or network.
6.2 The provider owes us no fee for the listing, and we owe the provider no fee for using its data.
6.3 The figures in the provider portal (such as visitors we forwarded) are for information only. They come without warranty and are not a basis for billing.
7. Liability
7.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
7.2 For a slightly negligent breach of an essential obligation, whose fulfilment makes participation possible in the first place and on whose observance the provider may regularly rely, our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. This applies in particular to lost revenue due to incorrect, delayed or missing display.
7.3 The provider indemnifies us against third-party claims based on incorrect, incomplete or unlawful information in its data for which it is responsible, including reasonable costs of legal defence. It supports us in defending against such claims.
8. Term and termination
8.1 Participation runs for an indefinite period. Either side may end it at any time without notice, the provider by email to [email protected].
8.2 After termination, we remove the provider's offers from the display within a reasonable time, stop fetching its data and delete its provider portal accounts. Section 5.2 remains unaffected.
9. Data protection
How we process personal data of contact persons and provider portal users is described in the privacy policy. Offer data in the feed contains no personal data.
10. Changes to these terms
We may change these terms with effect for the future, for example if ServerRadar24, the feed format or the legal situation changes. We notify providers with provider portal access by email at least four weeks before changes take effect. If the provider does not object before they take effect, the changed terms apply; we point out this consequence in the notification. If the provider objects, either side may end participation under section 8.
11. Final provisions
11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
11.2 If the provider is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from participation is Neuwied, Germany.
11.3 Should any provision be invalid, the validity of the remaining provisions remains unaffected.
